A building permit is not required to build a fence unless a swimming pool or hot tub is on the property.
To apply for a pool permit, please use the online application process available on Cloudpermit.
A fence in a side or rear yard must be no more than 2 meters above the adjoining ground level and no more than 1 meter in a front yard.
Exception: A maximum of 3 meters may be constructed along the perimeter of lands used for commercial or industrial purposes.
To confirm where your side, rear and front property lines are located, please refer to your survey. Fences are not permitted to be built on Town property, so please ensure you are maintaining the required distance back from the Town's curb or sidewalk.
The Committee of Adjustment is a quasi-judicial body with authority delegated to it by the Town of Niagara-on-the-Lake Council to hold public hearings to make decisions on Fence Variances.
Prior to the submission of all applications to the Committee of Adjustment, applicants must have a pre-consultation meeting with Staff. Meetings are held virtually via Microsoft Teams. In order to schedule a pre-consultation meeting, you need to provide two items:
- Complete the first page of the pre-consultation form and send it back. Section 5 must clearly outline what relief you are seeking. Staff will fill out the remaining pages.
- Provide a site plan drawing of your proposal. Show the lot lines and road and all existing buildings and structures on site with all measurements in metric.
Once these two items are received, your proposal will be assigned to a Planner, and a virtual pre-consultation meeting will be scheduled. Materials are to be submitted electronically to: planning.development@notl.com
