A Temporary Encroachment Permit will be needed when an applicant is required to temporarily close, work or encroach on all or a portion of a public street, lane/alley or sidewalk for activity associated with building construction/maintenance on an adjacent property. The work must be temporary in nature and may include but will not be limited to the following:
- Placement of a mobile unit, waste bin, storage roll-off, crane, scaffolding,
- hoarding or construction equipment & materials
- Ditch or boulevard improvements, or road boring
- Use of public park space for access to private property
Prior to issuance of a Temporary Encroachment Permit, the applicant will be required to provide the Town of Niagara-on-the-Lake with the following information.
Permit Fees:
Permit fees are due upon application approval. Fees are as follows:
- $25 - Residential
- $100 - Commercial
Note:
The applicant must ensure that pedestrian access is maintained at all times during work and that all efforts are made to minimize inconvenience to traffic. The applicant will be responsible for all costs if damage is incurred to the curb, sidewalk, boulevard, or roadway as a result of the work taking place. As such, the Town of Niagara-on-the-Lake may request a refundable damage deposit at the time the permit is issued. During the months of May-October, the Town of Niagara-on-the-Lake may also request a deposit to cover the potential revenue lost as a result of parking locations being obstructed.
Limited permits are issued for Queen/Picton and King Streets between Victoria Day and Thanksgiving, or during special events.
Please submit your permit application at least 5 days before the proposed start of the project to allow circulation to other Town Departments for comment.
