Temporary Encroachment Permit

A Temporary Encroachment Permit will be needed when an applicant is required to temporarily close, work or encroach on all or a portion of a public street, lane/alley or sidewalk for activity associated with building construction/maintenance on an adjacent property. The work must be temporary in nature and may include but will not be limited to the following:

  • Placement of a mobile unit, waste bin, storage roll-off, crane, scaffolding,
  • hoarding or construction equipment & materials
  • Ditch or boulevard improvements, or road boring
  • Use of public park space for access to private property

Prior to issuance of a Temporary Encroachment Permit, the applicant will be required to provide the Town of Niagara-on-the-Lake with the following information.

Note - If the work cannot be completed during the time of which the permit is issued the applicant must contact the Town in order to receive an extension.
Provide a dimensioned sketch detailing detailing street/sidewalk/boulevard, encroachment location, dedicated parking requirements and proposed signage placement including any closure signs and barricade locations along the sidewalk or roadway, including protective (reflective) markings or signing for items placed on the roadway which may be a hazard to traffic. A copy of the traffic protection plan is also required for fixed or mobile operations which occupy any portion of the roadway.

Provide a list of vehicles involved with the work and their license plate numbers (if dedicated parking is requested). The equipment and vehicles should be confined to the area identified in the sketch.
Applicant to provide a proof of liability insurance certificate in the amount of $5,000,000.00 per occurrence covering the span of the proposed encroachment, with the Town of Niagara-on-the-Lake as an additional named insured. If the owner of the property is providing the insurance on behalf of the contractor performing the work, the contactor must be included as an additional named insured as well.

Permit Fees:

Permit fees are due upon application approval. Fees are as follows:

  • $25 - Residential 
  • $100 - Commercial

Note:

The applicant must ensure that pedestrian access is maintained at all times during work and that all efforts are made to minimize inconvenience to traffic. The applicant will be responsible for all costs if damage is incurred to the curb, sidewalk, boulevard, or roadway as a result of the work taking place. As such, the Town of Niagara-on-the-Lake may request a refundable damage deposit at the time the permit is issued. During the months of May-October, the Town of Niagara-on-the-Lake may also request a deposit to cover the potential revenue lost as a result of parking locations being obstructed.

Limited permits are issued for Queen/Picton and King Streets between Victoria Day and Thanksgiving, or during special events.

Please submit your permit application at least 5 days before the proposed start of the project to allow circulation to other Town Departments for comment.
